Illegal dismissal occurs when an employee is terminated without a just or authorized cause, or without due process. The law requires employers to have valid grounds for termination and to observe both substantive and procedural due process before dismissing an employee.

What are “backwages”?
For certain cases, we may accept cases on a contingency basis—meaning no legal fees are charged unless we successfully recover on your behalf. An employee who was illegally dismissed is entitled to:
Reinstatement to their former position without loss of seniority rights, and/or

How long do I have to file a labor case?
You generally have four (4) years from the date of your dismissal to file a case before the National Labor Relations Commission (NLRC). However, it’s best to act as soon as possible to preserve your evidence and witness testimonies.
